I am writing to advise that defamatory and offensive comments were made by the user of Telstra IP address 101.173.117.136 (identified user David Smith). The relevant authorities (Victoria Police) have been notified of this conduct in accordance with Section 474.17 of the Criminal Code - using a carriage service to menace, harass, or cause offence. We also advise that is our intention to pursue further civil legal recourse against Mr Smith, action that will extend to Telstra (the carriage service), should appropriate action not be taken by you to prohibit the continued use of your carriage services by Mr Smith. Mr Smith used facebook as the medium to make the defamatory and offensive comments at 6.53am on Friday, 1 September 2017. Due to the nature of the comments, they have subsequently been removed and Mr Smith has been banned from accessing the facebook profile. However, the criminal act committed by Mr Smith remains to be dealt with by Victoria Police and Telstra.
